Im in California and want to know... if I put 4:10s and get it tuned, will my car pass smog?

Only if the tune does not turn off the sensors. Otherwise, you would need to change back to stock and possibly drive 200+ miles to get your OBDII sensors to turn on properly to pass smog. On Both my car tunes (stock rears) have to be turned back to stock to pass smog.
