Driving to Naples, Fla. and back for a vacation during the Thanksgiving holiday, my Marauder never missed a beat.... neither did the Valentine 1. On the way down (I95 - 10 - I75) saw many highway patrol officers.... got many looks but no one stopped me, was doing 7 - 8 miles over the speed limit. Did get "the look" from many drivers that saw my Marauder behind them and after they moved to the center / right lane the look on the drivers face after he / she realized that it wasn't a police car..... priceless. Happens all the time...

Any way... on the way back Saturday night, on I95 in South Carolina the V1 goes off (still doing 77mph in a 70mph zone)..... I pass the S.C. HP in the center medium and I see his lights go on..... I pull over and he says I was doing 87mph in a 70.... I told him my speed control was set at 77... he says it's inaccurate since I have non-stock tires on my vehicle.... I tell him they are stock, even offer to show him the tire sticker and owner manual.... he declines the offer and writes me a ticket for speeding - 87 in a 70, then he has the nerve to tell me that the judge will most likely lower the speed & points....

Any suggestions on how to get this speeding ticket thrown out? I'm collecting everything I can that shows the stock tires & rim sizes...

BTW.... while traveling home thru Jacksonville, Fla. on I295, was right next to a Fla. Stat trooper, speed limit was 65, had my cruise set at 63 and we were side - by - side for about 5 miles... V1 was screaming all the time....

If you think he miscalled the speed, then you will need to subpoena the maintenance and calibration records for his equipment. Problem is, you *were* speeding (+7 over). Not sure its worth the effort to try and prove you were only speeding "this much" rather than "that much."

Definitly plead NOT GUILTY. Have your day in court. Sometimes a no show by the officer = Not Guiltly.

Ahem....

77 is "SPEEDING" in a 70 MPH zone.....so don't ever mention you were "cruising" at 77 MPH....Da Judge will flip out!!! :mad2:

I have several friends that are LEO and they all said basically the same thing :

1 mph over the limit is speeding and subject to a ticket.

Bummer. I've gotten many many tickets, and the Officers were doing thier job and caught me fair and square. Only one sticks out in my mind that I didn't deserve, because I was actually under the posted limit, just putzing along in a State Park enjoying the scenery. When he asked if I knew why he pulled me over I honestly had no idea. Thought I ran over an endangered squirrel or something. Anyway, I just sucked it up and paid the damn thing, but I know I was innocent. AND SO DO YOU, MR. MOTORCYCLE POLICEMAN GUY FROM FLORIDA WITH THE SHINY GLASSES AND BIG BLACK LEATHER BOOTS AND STUFF!!

...........huh...my question is--uh...why didn't you slow down when the V-1 went off??..isn't that why you got it?...I do when my radar goes off no matter what for or why or where--I'm not about to 2nd guess the darn thing--it sees something I surely don't.......so go ahead and tell me --if you had slowed down , do you think he would have pulled you?......Tom

I'll answer that one.

YES he would have been pulled over. Why? He has a nice car. They do that much of the time. They see dollars, not safety fines.

I was pulled over for the exact same reason, but they called it "passing against the marked passing zone" and it was total :bs:

My day in court (having been continued twice) is Dec 30th. I hope to get it continued until this guy gets transferred so he doesn't show up. It's been 9 months and he's written how many tickets, and I have only received one, but I bet somehow his memory of the event will be much better than mine . . ..

I have researched this quite a bit, and there are a number of websites out there that can help you - do some Googling.

This has nothing to do with safety. Now I know that if they ever do this to you again, have them WRITE it on the ticket. (the non-stock tires thing) They will probably refuse because they know they are lying.

The radar evidence will not be submitted or it will be falsified.

Do some poking around - you might be able to get out of this if you're confident enough and ask the right questions.

Do not take the stand in your own defense, but rather use your right to cross examine the officer.

I didn't slow down because most officers usually "give" you 15% over the speed limit. As I mentioned I had no problem going thru Fla. at the same 7mph over the speed limit.... and Fla. was crawling with troopers.... The real reason I think he stopped me was the appearence of the oversize tires on the Marauder. Oversize tires = incorrect speedo.

I kinda agree with you on the crusing spped about 7 over thingy , but still, when the alarm goes off--I get off the floor ---anyway---even with troopers near by or riding along with me--I let them stage the pace until they get bored and then they move on to the next off ramp.....just this past weekend going to Ashville,NC via S.C., they had two marked patrol units parked on the side of the road , no troopers inside but they did have it set up that a radar unit was giving off waves cause my unit was screaming before and thru their parked area--so to let those with radar detectors know as well to slow down as well...anew twist to an old trick.....but it worked......Tom

Florida has a 15mph rule. More points and higher fines.

Since you admitted you were speeding, but not as high as he claims, a Florida judge would probably let you off with the lower fine. Unless the ticket was issued in Jessup! Speed trap city, FL 0U812

Also in FL by statute they have to give you 5 over and 7 over is 78.50 vs. 113.50 for a moving violation but 17 over here is 178.50 (prices are for Lee county).

Anyway I was in traffic court on the 29th and there was a guy in there who kept bumping his court date up, in any case some how he bumped for 2 years and when he got into court he got it dismissed because the deputy couldn't remember anything about that day and didn't have his radar log. So if you take the court option think of some good excuses to keep bumping the date up. Or if you know somebody that knows somebody in that dept. they might know him and you can find out ehns he's on vacation and get that date...
