After wasting almost 3 months dealing with some evil dispute reps, today I finally called their boss, he seemed cool, and understanding. I explained my situation and he said he would try to solve the problem.
about an hour later he called and left a message that he had emailed Lincoln Merc division asking them to find me a MM anywhere.
I offered to pay to have it shipped here if they could make the exchange happen, so hopefully monday he will have a response from them.
So til then, can you all stay away from that black MM in TX with the sunroof.

I will definitely post my vin later so you can all steer clear of my lemon.

Good luck (meant in a good way) finding a new Marauder. If it is to be registered in CA I believe it has to come from CA, NY, or MA which require cars with the CA emissions. I'm not sure that a 49 state car can be legally reprogrammed and sold in CA.

I believe all Marauders are CARB certified.

I believe all Marauders are CARB certified.You are correct. I just looked at the sticker under the hood and it says that the vehicle is certified for sale in CA. The Marauder qualifies as a Low Emissions Vehicle.

I went thought this awhile back, since I am in NY and wanted one with NY cert. Not all Marauders are NY,Cal,Ma certified, but many Marauders which were sold anywhere around the country are certified. At least this is true of the 2003 model year.

Vermont uses CA emissions as well....
