I was on a fire call yesterday and got to talkin to one of our local cops about the marauder i bought and was fixing. He told me that they had confiscated a 04 maroon marauder and they were going to start using it as a patrol car. The sheriff has a black 03 marauder he bought as his patrol car.But he said he was going to hand it down and was going to get a dodge charger as his new car. I just thought this was pretty cool.

If that was the case, I don't feel bad for him at all...I'm glad the car will be getting a good home.

Not true at all....... (although you did say usually!!!! :beer: )
1) you get pulled over with a relatively small amount of even marijuana and they can take your car. You dont have to be a drug dealer to have your car taken. And some drug dealers dont have their cars taken because of the attorneys they have and who they keep their car registered to.....
2) in Florida your car 'WILL' now be taken if caught street racing. It doesnt even have to be fast and the furious kind of street racing.... Just playin around light to light will get your car taken...
Just because a cop has it doesnt mean it will be a good home either... Most patrol cars are beat to death.
I wont tell you where I fall in any of the scenarios above. But I will say I know people that have/do meet every equation above. So nothing above is heresay.

The "good" news for defendents, on Florida police vehicle seizures/confiscations at least, is that the various state statutes that apply here afford the vehicle owner a couple of pretty fair hearing opportunities after the vehicle is taken. There is a sort of civil probable cause hearing available within the first few days to determine if the initial seizure was justified and should even porceed further; a good number of vehicles are returned at this point. If the forfeiture is judged adequate to proceed this same hearing also provides for the judge to decide on the "least restrictive", safe way the vehicle should be held. Many agencies don't want to get into long, drawn-out litigation over anything but the most valuable asset seizures ( nice/big boats, ships, aircraft, expensive/exotic cars etc) and will probably return the vehicle for a "fee" rather than chance going to a full civil trial over the matter. However.... there are always exceptions, like if the offender was a real as*hol* about the whole thing or the crime alleged is something real nasty.
Gotta agree with the post about the cops beating the crap outta that seized Marauder.... when that thing is finally turned over to the P.D. for use the brass needs to make sure it's assigned to one of the more mature guys as a take-home car. Just my .02, BILL.

Read the Constitution, many vehicle seizure laws are clearly unconstitutional, as in no due process.
I have read of too many cases of gross abuse.
They take your vehicle or boat and in most cases you have to spend a lot of time and money trying to get it back.
I test drove an Impala SS. The owner of the dealer had just pulled up and the salesman let me drive it. I noticed a roach in the ash tray and immediately drove the car back to the Dealer. It ended all interest in my purchasing a car from that Dealer.
The USCG tried to confiscate my boat because at nite they had difficulty reading the VIN on the transom. Fortunately I new the VIN was there and was able to convince them it was there and unaltered. Droping the name of a local Admiral that I had just spent the 4th of July with probably helped.

Todd, your points are well taken...I guess up here in Taxachusetts vehicle confiscations are more rare, and are usually (there's that word again) the result of more serious crimes...

It pays to know your state laws as they vary greatly state - state. Vehicle confiscations where I live/work are fairly rare and reserved for maggots traffiking garbage and misery.

Here in NYC up until recently, If you are caught drinking and driving, your Car is GONE, If you Street Race, GONE , Double the Speed Limit, GONE, High Speed Chase, GONE , Used in a drug deal or any other Crime, GONE, Too many Parking tickets, GONE!. Its easy to lose your car here in NYC and when the police get a hold of it, Consider it a Junker. They destroy Cars here, they Park it wherever they please and they never clean them, So I guess its better that the DTR Marauder Lives in Florida then spend its days here in NY.

Here too. I was doing a story on Nashville's metro government using the web to auction off cars from the impound lot. I thought it would be cool to go out and see what cars were there and how they got there.
It was utterly depressing to see an ocean of cars basically rotting in place. Basically, they just park them and no one touches them for literally years ... so by the time they're cleared for sale ... the tires are shot, paint is blistered or peeling and the inside (which is never cleaned out) has been cooked to death.
When I asked the guy what was the worst he'd seen, it was a really sweet Caddy that had some fast food and groceries in the backseat when it was towed in then spent several years in the sun ... you can just imagine the stench and what it did to the interior.
