If I buy a car from Bill Heard, drive it home, then discover I could have bought the same model for less money somewhere else, I made a "mistake" that Bill Heard knew about and therefore I can call the deal null and void?

If the dude had really paid cash, as in cashiers check or bank draft, I think he would have had a very strong case, Tennessee Law notwithstanding. The hold check is what will cause the dealer to prevail. Technically, he hadn't paid for the truck and it still belonged to the dealer.

I think he should take the $500, or buy the used Silverado for what they are offering it for... which sounds to be their actual cost. Actually, I think if he offered to buy it for $500 below their cost and have then throw in an extended warranty or free oil changes, they'd do it.

Exactly, Its not a Un-authorized use of the vehicle. The Dealer has to suck it up, mistakes happen, Let them fire the salesman and move on.

At least in FLorida if you sign a contract and take the car off the lot, its yours, unless you sign a form called the bailment agreement, which basicly says if only the lender find you to be declined, they can repo the truck, however if he paid cash the truck is his.

That is such BS, the sales manager is the one who sets the price and the salesman is the middle man in all this. Even if the sales manager made the mistake, the F&I guy who gets the customer to sign the tag, title, etc etc forms should of caught the mistake because they are usually the ones that get the actually dealer invoice of the vehicle and put it in the customers folder. I've worked at a Chevy, Ford and Dodge dealerships and they all pretty much handle things the same way, the only thing that is different is where things are and what they are selling.

Something kinda like that happened to my wife when she bought her 1st car, the dealership put her on dealer tags because it was after closing when the deal was completed and they let her have the car for 11 days before contacting her to say "oh you have to bring the car back cause the loan wasnt approved". We took the car back, demanded our 4K down payment back after we made them look over the car to see it was in the same condition was when we bought it took our money and left. We went down the road to another Pontiac dealership, found the same type of car, got a better deal and got an approval of the loan within 60 mins and drove out with hard tags in under 2 hrs and went back to the other Pontiac dealership and the wife let the manager have it :argue: , all while I just stood by the door laughin my azz off. After she stormed out I went up the manager and told him "I could of really brought you some business if you had done us right (I have 300+ client's I service every month and someone is always in need of a newer vehicle) but I will make sure you get no business from my family, friends or my client's". I will always recommend someplace that treated me good and gave me a fair deal until they burn me.

It's pretty clear the Nashville BBB considers Bill Heard a crook and his dealership has a mountain of complaints. Also, the TV anchor laughed at Heard's "explanation" that it was the customer's fault. I wish the DA would have allowed the police to file theft charges, and hope the guys suits the ****z out of the dealership.

That said, I wonder if it's management at that particular dealership that are shady, or if this is standard operating procedure for the entire chain of Bill Heard dealerships. He owns 14 Chevrolet dealerships plus a Caddy and Saab dealership.

Their dealership in Sanford got in big trouble a few years ago for pulling stunts like this. If I remember correct, the State fined them for keeping a couple in the dealership against their will. When the couple decided to not buy the new car, the dealership "lost" the keys to the car they drove in with (I.E., their trade) and the couple had no way to leave. Bill Heard also pulled other fast ones like this, so the State decided to step in.

One day, I was in the Publix near Bill Heard, and I saw a guy in there with a Bill Heard Nametag. Asked what he did there, and he said he was "The Sales Manager". I then told him that he should be ashamed of the way they (he) do business. His answer to me was, "Yes, but WE MAKE DREAMS HAPPEN".

Scumbags.

I worked at the Las Vegas Bill Heard dealership for almost a month before I finally decided no job was better than a job with Bill Heard. To call them "sleazy" is being kind.
