View Full Version : How to collect from a uninsured motorist?

Just like the title says, has anyone ever had success with this? The marauder got Hit in the rear bumper about a week and a half ago, causing about $400 worth of damage. Get all the persons information and they say that are going to pay out of pocket. Get an estimate, and he tells me he will pay me after the weekend. Doesnt return my calls a few days later when he is supposed to pay up, so I call his insurance carrier only to find out he was canceled a month ago for non payment. Any advice on how to collect on this? I'm in Long Island, NY if that helps.

there might be something in your insurance policy about underinsured people hitting you... also I hope you have a police report... this is why you ALWAYS get a police report

Skiordie, New York is a mandatory insurance state. The authorities will be very interested that he was driving without insurance. The DMV will immediately revoke his registration and drivers license. I would approach him on that basis, get your money and then report him. Good luck. Put that DB on foot. Dennis:beer:

Sue him in small claims court, sounds like an open and shut case. I'd also include a bit extra for the incovnienence of having to track him down and go to court.

I got rearended while I was driving my wife's van. The guy took off but I got his license plate number. I called the police from my cell phone and luckily another motorist saw the driver leave. I turned it into my insurance. I got a check to repair the damage less my deductible. My insurance company went after the hit & run driver and about 5 months later I got a check in the mail from my insurance company for my deductible. My insurance agent said my rate would not go up because it was not my fault.

If you have full coverage claim it as hit & run .if not then this is your next best way to collect and attach to his wages(if he has any).

Without a police report it may be very difficult to collect, as it becomes a "he said, she said" type of case. Approach him threatening legal action, maybe he'll cave in and pony up.

Louisiana is also a mandatory auto insurance state. Check your renewal statement it will show a listing of all the things that are covered in your policy.

It would probably be listed as "Uninsured Motor Vehicle, bodily injury 25,000/50,000.
My cost is $43.00 for six months.

I also was rear ended by an uninsured motorist, my company paid for the repairs, less the deductable. Never did get my deductable back so I guess they weren't able to collect.

The problem is with only $400.00 in damage is your deductable higher? Which means you won't get anything, but have an accident tick against your record (not good).

Sounds like a good small claims court but even still there are limitations such as being in the same jurisdiction. Otherwise it's going to a Justice of the Peace and believe me they can get things done if they have a mind too. Powerfull people.

What county is this in? If Suffolk, send me all pertinent details via PM, when where, plate#, description fo driver/driver info.....we have ways of making them talk.

If you dont have a police report go up to the police station and report it then give them the info you collected. They will call him and give him so much time to bring that vehicle to the police station (hopefully you wrote down the VIN) They will ask him for his proof of insurance then you will have your police report and be able to have an open and shut case in small claims. If he doesnt show up to the police station with that vehicle they will file it as a hit and run then you can go the route of your insurance company getting you your deductable back. I'm not a lawyer, but I rear-ended a guy in a company truck and the owner of the company that I worked for said to just exchange info. The guy then claimed I did 4000 dollars worth of damage to an 85 Corrolla which wasnt even worth that so my boss told him to shove it and he went to the police station and reported it and I got a call giving me 5 hours to be up there with the vehicle or it was a hit and run. Not sure what came about cause I was out of the picture after I got my failure to yeild ticket and paid it the rest of it was on my boss. From what I hear since MI is no fault state he just got 500 bucks.
