I received a ticket yesterday for traveling through a safety Zone (Thats the yellow lined area in between opposing lanes of traffic)

When i received the ticket I noticed that the Licence Plate Number of my tahoe was incorrect - two letters were switched

any chance this will be dismissed?

Depends, Back in the day when i was getting lots of tickets with my 5.0 Mustang, and spending lots of time in traffic court, I saw some people get their tickets dismissed by the judge because of 'technicalities' like yours.
I also saw cases where the judge could've cared less about it, and still nailed the guy with the traffic violation.

It's possible, plead No Guilty and go to court.

The problem I see that the summons was personally served.
This may allow the officer to ammend the summons.

Chances are no, the moving violation does not go against the owner of the car, but the holder of the DL#. So, any info like a license plate error, etc. is irrelevant. I do suggest If you have priors, go to court and hope the cop doesnt show. Otherwise, supervision and traffic school is a ever so simple alternative.

That is called a "painted curb" and I guess they are illegal to drive on. Thank goodness they nailed a bloodthirsty, dangerous menace like you for such a heinous crime. You should drop your head in shame. Now go to confession.

PERSONALLY, I would just pay it.

On the way out....leave them a couple of nice lines to look at ;)

It is a moving violation and your Driver's License is recorded on the violation.
If your Driver's License number was recorded incorrectly, then maybe.

Go to court and hope the cop doesn't show.
If he does, try to talk to the cop before you see the judge
and explain your reason for driving in that area.

In the meantime, you should attend a defensive driving course
and bring the certificate from the course to court with you.
Show it to the cop and the judge and they may dismiss the ticket
or at least lower it to a minor infraction with no points and just a fine.

Defensive Driving courses here run about $50 - $60
and you get 10% discount on your collision insurance for 3 years.
That saves me at least $285 over 3 years.
It's not a bad return for your money, even if you end up not having to use it
to offset the charges the points would add to your insurance.

Clerical errors are not factual errors in regards to the nature and type of violation and the identity of the person cited for that violation.

In other words, they will not result in the dismissal of the charge (at least not in Texas).

You can do your course online nowadays, if you have a higher speed internet connection. I did my last one online and faxed the certificate in to the court office to get the points dropped.

Going to drivers school is mandatory for DUI's, don't think it would matter for a simple traffic violation. Most insurance companies for don't get excited unless you have multiple infractions in a short period of time (6 months).

Listen to old people. You made a mistake, and since there were no speed, failing to yeild, or stop sign issues involved, just pay the fine and chalk it up to it being your turn to pay. It's the price of playing the traffic game; just think about all the times you didn't get stopped. :rolleyes:

Driving school isn't that bad. When I went to drunk school I met some great drinking buddies. Another buddy met his wife in drunk school and they've been married for 26 years now.

Not new but still funny, thanks, Dan. If you did it, what is the problem with paying the fine? If you think the traffic laws don't make sense work to get them changed. Don't look for some way to weasel the system. You can get past this and perhaps be a better driver from now on. I am not a Leo. We need to respect those that are and support the job they do for us. Transposing License plate numbers/letters may be cause for dismisal of a ticket if you were stopped for speeding by a LEO using laser or Radar..........

The argument would be something like this......Your honor...If officer...... Cannot copy my information properly, how do you know that he operated the speed measurement device properly??? You may get the benefit of the doubt depending on the Judge and your priors..... I believe a Judge has sole discression here.

Getting stopped for driving over the painted curb, you cannot use that argument. That is a visual infraction, not something that you can point to improperly used equipment for.

In the end I agree with Dennis tho...If you did it, buck up a pay If you don't get caught it aint cheatin, but sometimes you do:D .

The LEO was just doing his job. Up here in Atlanta, I would love to see LEO's be a little more aggressive about things like this, improper lane changes, and dirving to endanger type stuff. It would help in this crazy town for sure.

I always consider the yellow lines to be a brick wall, and that way I seldom cross them... A solid white is also a barrier.... so you can't cut across parking lots, etc. I would probably just pay this minor infraction and be on my way...being forever embarassed....RAM
