View Full Version : Ticketed for illegal exhaust VA
This weekend while attending Fun Ford Week Bristol I was ticketed by the local police for having an illegal exhaust and not wearing my seat belt. This is total B.S. I think the local County Police force was on a fund raising drive that weekend. It's no way may car was loud, but it was modified. I didn't want to press the issue too much because I had removed 2 Cats and that may cause additional problems. The total combined fines were 130 dollars. I will pay the tickets because it cost more to drive 6 1/2 hours to court.

Even with 2 CATs removed you would figure that the Decibels would still be at acceptable levels when at idle, unless your mufflers are getting worn.

I had a conversation with the Police Captain of Bristol City Police Tenn. while at the track. He inspected the car and said he couldn't understand the reason for the citation.

So you took your seat belt off before the officer walked up to the car? I've heard of a lot of cops doing that cause if they don't see that it's on when they walk up they automatically think you didn't have it on to start with.
I bet you were and still are ticked off about it all.

This might be true. I couldn't find a black male or female in the town and no mexicans. I looked very hard. In Wal-mart, Burger king, Hotel maid service, trash men, Quickie Marts, Gas Stations, and other places. They were not to be found.

Ouch on the seatbelt one...yeah either fundraising or singling you out, either way that really sucks...
The trend has followed north, I know of atleast one in our local club in N VA (not CAM a Mustang group) who got cited for illegal exhaust, he had aftermarket stuff but still had cats, mufflers, full tailpipes, etc.

The permit also verifys you have not been convicted of a felony or committed. To me that means don't call the BU.
No permit means you could be a felon or looney or both or neither and have a non-concealed weapon.
If that is SOP then they are stupid and wasting resources.
You might consider making some phone calls or their behavior will continue.
I am curious does the sealbelt law require whenever you are in the vehicle like while I am vacuming it or only while it is being operated?

that is some straight bull****... sorry man. I've gotten pulled over in a car so loud that the cop asked me to turn it off because we couldnt hear each other and i didnt get a ticket.
It also didnt have cats and was side-exit, so it would literally burn your eyes are traffic lights LOL

you would think they would have more important things to do than to bother normal people in a gdamn parking lot, and yes usually when cops see a concealed carry permit, they see a responsible individual, not a problem.

I got "detained" in VA out by that military base a few years back for robbing a Burger King next door to a gas station I went to take a piss. I vowed to stay out of VA from then on out...

A funny thing happened the next day. Pam and I meet Sherman's family at Shoney's in the morning. 5 Bristol Va police officers were parked around my car. They were looking it over with smiles. I came out of the restaurant to see if everything was ok. They began to tell me how they admired the car and wish they had one instead of the Dodge Charger. I explained to them that I was not happy with there town and how they treat visitors. The five officers looked in shock. Pam told them the story of the illegal exhaust from the night before. They all apologized for the citation, but I still gave them the MF under my breath as I walked away.

Bad tickets are very upsetting. I received a ticket at 1:30 am in the morning recently for rolling through a stop sign on a completley deserted country road with NO traffic and no street lights. The cop was 100 YARDS away. My wife was with me and was so upset at the cop I honestly thought he was going to arrest her. I went to court to fight it and I did such a good job in my defense the assistant DA became unglued and the judge threw her out of the court. The judge still found me guilty. The cop came up to me after the hearing and said in all his years going to court he never heard such a good defense against a traffic ticket. He said, "You did a great job". Unbelievable - !!!
My point is we all have these type of stupid tickets (and I could tell you about another one), but don't let an exhaust ticket get to you if you have no points.

I knew something was up when I had one behind me, another one at my 7 and the 3rd one was creeping up at my 5 on a 3 lane (one way directional) highway. They followed me for about 1/4 until I signaled over to get on my exit and thats when they lit me up. I wasn't speeding or doing anything wrong, guess they were hoping for DWB.
Had all my windows down, interior lights on and hands resting on the steering colum (top of the airbag) awaiting to asked for my info. Yet they pulled me over for 35% tint (33% if metered) and didn't say anything about my 6000k illegal HID headlights.....
There's a lot of bad apples out there that ruin a good officer name.

Your car may have resembled a vehicle that was wanted, and no you are not going to be told that. I do not usually comment on V&T stops when I'm not present, but it certainly sounds like Merc was wronged. FWIW, any alteration from stock on the exhaust system is a violation in NYS.

I questioned a State Police buddy of mine here in CT...he said" If the KEY is in the run position then you are still driving and all laws apply"
Case in point a fella pulled his car over and passed out from to much alcohol and left the car running, he was cited for DUI because he was still behind the wheel of a running car while intoxicated,simply turn the car off when you are stopped and a bunch of laws stop applying.

So why do cars get picked on when there is obnoxious sounding Harleys all over the place? They didn't come like that stock. IMO they sound like a** with all that noise, they should be pulled over ticketed, and towed.

After reading all the messages in this thread it is obvious to me you were harrased by the Mopar Good Old Boys. They even admited they were envious the next day. They were probably looking for a reason to bust you and impound and seize your car. They'd put purty blue lights on it and then they could finally catch them darned Duke Boys in their General Lee.
Seriously here in the MidWest I don't think the Police have ticket authority on private property, which a Mall is. I know they don't respond to fender benders unless there is a personal injury. You are supposed to exchange info and contact your insurance companies. Rick

What can you do? Rest assured that you and anyone worth their salt won't visit or spend a dime in that town for any reason. I'd rather run out of gas than support their economy.

Up here, this is not the case. You are DUI if you are drunk and the keys are in the car, anywhere in the car. Locked in the trunk and you in the back seat, your DUI.
Me I just don't drink, don't speed either except for that one time in England, but that wasn't my fault the road was too slow.
I wonder if a Camera would have made a difference in Merc's case?

I'm generally supporting of police and first responders and a law and order kind of guy.
that said, I'd sue the crap out of the city, and the individual officers as well. I'd be calling the state atty general, and doing whatever to start a civil rights lawsuit. if enough real people started enough cases like this (as opposed to show trials with jessie jackson and al sharpton, which only polarize and marjinalize the whole subject) this kind of crap would greatly decrease.
and likewise, the good police who wouldnt do this stuff need to stop tolerating or protecting officers who do, there has to be a line there somewhere between being able to back each other up, and covering up, mabey that line is too hard to see? I dunno.
I feel for you, and agree it sucks, it aint right, and it tickes me off too.
and on a similar tirade, as much as I prefer local control over federal control, I wish traffic laws were uniform nationwide, so you dont get blindsided by some crap local law you would have never suspected while traveling out of your home area. I've been here 3 years and I'm still trying to figure out what the heck they are doing here...

Merc, sorry to hear about your troubles down in Bristol this trip. The ticket sure sounds like :bs: ... maybe you ran into a rookie on a power trip. As to the perception of DWB, I :dunno: I can't relate.
To add a little balance to this discussion, I believe that this is the first and only such incident in several of your trips to FFW at Bristol over the last couple years. In fact, you have actively supported doubling up a Marauderville with FFW in August ... so I suspect that your previous experiences there have been pretty positive.
You are understandably peeved at this incident. However, I wouldn't let an isolated problem distort your view. Could be that you just ran into an Azz40le with a hard on that night. Just my :twocents:

The major difference between the last 3 trips to Bristol Tenn. was I stayed in Bristol Va not Johnson City Tenn as I usually do. Johnson City welcomes their visitors. Bristol VA doesn't have the Thunder Valley event facility that draws millions of race fans every year. Bristol Va uses their police force as means to generate funds. So next year I am staying in Johnson City again. I will never spend a dime in Bristol Va.

NS is like AB, I think for DUI. However, seat belts are not required on private property, ie a parking lot. I'd still wear one, though. I'd fight it for that one alone unless your state laws are different.

Local cops busting people for no reason just to make money to support them sitting around. Rural cops are not on my list of favorite LEO's I like staties and city cops..you know the ones that acutally do stuff.

Sounds like a crummy situation, atleast you now know what to avoid to have a good time there, but it sucks anyone would have to deal with that.
I wonder how many other complaints there are from other FFW attendees? Maybe there'd be enough people to get a complaint issued or have their police force checked out if they were issuing nonsense tickets?
It might also be interesting to see how many other complaints there were and if they were cases of DWB - which that in itself sucks big time, btw.

On another note, regarding rural police, I remember a few years back my folks got stopped in a town in West VA, they were out of state and got caught at a speed drop through one of the small towns. (You know, where you crest a hill it goes from 55 to 25 and they wait for ya)
Anyway, they got nabbed, and the officer was polite, nice, and reminded them the speed limit and that they just want people to drive slow through town. They got a warning and a have a nice day.
Those kinda situations are often big revenue generators - catch people cutting through town who don't know the limit drops - easy money. But in this case the emphasis was more in educating folks about the limit change which might be easy to miss and safety rather than making a buck.
So who knows...maybe there's hope yet.
At the end of the day though I think it's safe to say there's a mix, a mix between the good and the bad, and yeah sadly the bigots too.
Perhaps if Bristol wants to make their town an unwelcoming place they will be rewarded with less visitors and the pain of lost revenue - honestly if it wasn't for racing events Bristol wouldn't be a dot on the map you'd think they'd be as welcoming as they could be considering the race events and FFW's are probably their biggest revenue generators for the town...(and I don't mean giving Merc unnecessary tickets at Outback steakhouse)

For every up there is a down I never said all rural cops - just all in my own experience, which is not having experienced everything.
But I do not to get bit by a radioactive spider multiple times hoping to turn into spiderman, odds are I will just die of posion...
So I avoid spiders...just like I avoid rural areas :)

This weekend while attending Fun Ford Week Bristol I was ticketed by the local police for having an illegal exhaust and not wearing my seat belt. This is total B.S. I think the local County Police force was on a fund raising drive that weekend. It's no way may car was loud, but it was modified. I didn't want to press the issue too much because I had removed 2 Cats and that may cause additional problems. The total combined fines were 130 dollars. I will pay the tickets because it cost more to drive 6 1/2 hours to court.
So how did the car perform? ET/MPH? Did the tranny work good? Very interested, as I'm about to put my car back together and want to know what to expect from Darrin's tranny work (and the tune's control of it).

My car failed to shift to 3rd gear on the first run. Under 1/2 to 3/4 throttle it shifted fine. On the second run I tried to lift and then re-engage. My best MPH was 103, down from 114. My best ET was 13.01. I have had nothing but trouble from this transmission. The tuner blames the builder and the builder blames the tuner. I am going to see Darrin at his shop in Indiana next month. Hopefully we can iron this problem out over the weekend. :argue: On a more positive note the car pulled hard in the summer heat and I was able to get 1.74 sixties all day. If I had 3rd gear I would have ran in the low 12s. Sherman has some interesting problems. He started out on meth doing low 12's, very low 12's. Towards the end of the day Chis turned off the meth and Sherman got into the high 11's. That was impressive considering Bristol is a slow track.

Sounds like you guys had a great time! I hope you get the trans/tune issues worked out soon your car is gonna be quite the beast when fully unleashed!

Very disturbing. At least he stands behind it (I think), but it gets really aggravating having to keep taking the car apart. Still sounds like the tune. I discovered in my tuning attempts that the WOT tables don't necessarily tell the tranny what to do and I had to change the shift schedules to reflect the shift points that I wanted in addition to setting the values at WOT.

Meth won't help performance unless you add a bunch of timing. Then it's dangerous if you run out. Personally I think it should be used as a safety supplement for WOT street use rather than performance enhancer for the track.

Lonnie is doing the tune and I am staying at his house for the night. I am determined to figure this thing out.

I can recc the ProRacer Software, ~$300 and you can look at the tune as well as make all the adjustments a tuner can.
It's not that difficult. the first time you open the tune it is intimidating due to the number of files. The tuttorial is good and the tech support is excellent.
I got my shifts down after a little tutoring from Dennis R in one pass at the track.

In theory it's possible that even with the Alcohol the IAT were at max resulting in timing being pulled. If the temps dropped as the day progressed the IAT may have been less than the max w/o Alcohol.
The ITA2 temp on Sherman's car was at 160 after a run. Chris was data logging most of the Test-n-Tune runs which ended around 3:00. I don't have a ITA2 installed yet. I hope to correct that in the next 30 days.

Do you know if the 160 was w/ the alcohol?
I am probably going to go w/ alcohol. Chris showed me their set up.
He said he was going to data log w/ and w/o alcohol and send me the results at the dyno tune but I forgot to get his email.:confused:
