i just had a thought about something i should have looked into when i bought my car 10 months ago
I bought her at a ford dealer in abbotsford i never realized she had a 4.56 rear axle ratio. previous owner removed the tune when she sold it so it drove thinking it still had 3.55's.
here comes my point. the speedos at least 15k/h off all the time and this can sometimes be annoying as ill have to guess my speed based off the tach instead. im wondering, had i pointed this out before buying it, if ford had any responsibility to tune the speedo before selling the vehicle.
had this been sold from a nissan dealer etc i wouldnt even care but heck its a merc/ford and everyone there knew what the car was.

You need to contact Marty at MO's to get a fine and tuner.
BTW..... how do you know it's got 4.56's?

Claim odometer fraud and watch how fast they adjust it..
Or how fast they laugh. Wouldn't hurt to ask, wouldn't think it to be a big deal.

since theyre selling a vehicle that had modifications that affect accuracy and operation of the speedo and odo it could well indeed be a case of odometer fraud.
if i had a dollar for everytime someone asked me how i know its got 4.56's lol. ive done the drive shaft rotation check, a friend of mine who knew the previous owner also confirmed and at 100k/h im turning 2500 rpm

I ran into the same thing with my last car. It had 4.10 gears when I bought it but the tune was removed, if it even had one. You really need an entire tune to adjust shift points and re calibrate the speedo. There are a few vendors on this site to get a tune from, and trust me you want a tune.

oh yes im aware i need a tune badly lol i already spoke with marty about a tune. too poor for it right now. this isnt like an end of world situation. im just curious as to whether or not i could have had something done about it before i bought it.

Technically it is Odometer fraud at least here in the states it is. However there is a loophole here not sure if it applies in Canada as well but in most states used cars are sold as-is where-is no warranty unless otherwise noted in the contract. So it doesn't hurt to ask you can claim odometer fraud but if the laws are like ours it would be very hard to prove. And then since that is not a stock ratio your back to square one because its considered modified which is another loophole here dealers can claim they had no knowledge of previous owners modifications. Just a few things to look into/consider.

yeah proving it once ive already owned it will be impossible.

I think the sticking point is going to be whether the dealer knew the odometer was inaccurate when they sold the car. If the PO modified the vehicle, then removed the correction and didn't tell the dealer, I don't see how they can be held liable.

Yeah you'd have to go after the PO but good luck proving it. It will become a game of he said she said and they as well as the dealer will both claim they had no knowledge of any issues. Especially since its such a small difference most cars speedos are off by 3-5% from factory you could pull three random cars off the line and get 3 totally different speed readings. Its one of those gray areas I'm afraid. Your best bet would be to save up for a good tuner tunes are a good investment in general since you gain a lot of wiggle room when adding the go fast goodies later on so at least you'll be getting a little more bang for your buck money wise as I'm sure the dealer will only correct the speedo (if they even can doubt theres an off the shelf Ford tune for that combo). At least this way your getting some performance/shift improvements from it.

i dont think there are any vehicles that are odo exempt.

ive tried to get in touch with the PO but she lives some ways away from me. its such a first world problem for me to be worrying about something like this anyway. at least next time i buy a car ill be prepared with more checks.

Some States exempt vehicles over 10 years old. I am not sure of the rules in frosty BC.
