    Thank you! Thats just like the guy who found 50,000.00 in his attic while doing remolding. He gave it back to orig home owner who sold him the house 5yrs prior.     Being a lawyer Id like youre take on that Marty! U think if that guy takes it to court he'd have a chance to get some of that $$$ back? I wouldnt think due to his disclosure on item sale. It just seems like some judges side with stupid..

    The seller's best argument would be "I made a mistake."

    I think in court that argument would lose. The buyer bought a "pig in a poke" and the seller sold just that.

    The only mistake the buyer made is telling anyone. His whole windfall is taxable at the state and federal level as a gain.

    The guy had disclaimers in his original post.
    I don't he has a chance in hell of a Judge ruling in the sellers favor.
    As to the Buyer. He should have keep his B I G mouth shut.
